Andrew Sullivan writes that the "Musgrave Amendment"--the version of the Federal Marriage Amendment supported by the Alliance for Marriage, among others--is the "most extreme" choice because it would "mak[e] civil unions void."

Ramesh Ponnuru replies: ...But the crux of the matter is this question: Does the Musgrave FMA prohibit legislatures from creating civil unions for homosexuals? ...

What the amendment does prohibit is a court's
extension of a benefit that the legislature has reserved to married couples to other groups.
