SPOUSE AS A "SOCIAL OFFICE": Scott Fitzgibbon

[Scott Fitzgibbon is a professor at the Boston College Law School.]

I agree with Maggie that marriage is not (just) a right, or a consequence of the exercise of rights. "Spouse," "husband," and "wife" are the names of social offices, like "physician" or, in some societies perhaps, "wetnurse" or "nanny."
